Stop Garnishment

Wages can be garnished, meaning that the government or a private company takes a portion of your earnings before you see them, for a number of reasons, but the two most common are small claims court settlements and child support. If you want to stop garnishment, you will need to conduct your own research, but there are options available to you in some states. Be sure that you are following the law exactly because failure to do so could cause serious problems with your credit and your life in general.

When the issue is child support, check your state laws. Unfortunately you cannot stop garnishment in some states because they require all child support issues be resolved through the state. If you can work with your ex-partner, however, that option typically is best. You should be able to contact your local child support enforcement office where you will be advised on how to stop garnishment for child support.

Some people have their wages garnished for debts, such as credit card bills they did not pay. The best way to stop garnishment in these situations is to make sure it never happens. The process of court is expensive and time-consuming for everyone involved. Try to make payment arrangements with the company before you go to court. If you can come to an agreement, they will allow you to pay them under that arrangement instead of taking the money from your check. If you are past that point, you can stop garnishment if your income falls under certain minimum standards. When you reduce your hours or have other problems, you will need to return to court and ask a judge to halt the garnishment on your checks. These methods typically are only temporary, and your best solution is to pay off the debt as quickly as possible.
